 IMPORTANT CABINET DECISIONS OF
THE STATE GOVERNMENT IN THE YEAR--- 2011
27December,2011 Himachal Pradesh Cabinet in its Meeting held here today approved concessional TD timber rates to the right holders under  TD Policy for the year 2011-12.  Fixation of rates of TD Timber shall be on the basis of specie-wise weighted average sale rates of converted timber per cum (average gross auction rates) obtained by the HP State Forest Development Corporation Limited, in the open auction during the preceding year for calculation of TD rate.  In case, weighted average sale  rate(s) of any specie are not available, TD rate of that specie will be calculated by taking into account the TD rate(s) or weighted average sale rate(s) of species which is nearer in utility and quality to that species.  The BPL families will be provided additional concession so that they could avail of the facilities within their limited resources.
It has been decided that the Department of Industries will set up a Bio-Technology Park by at Aduwal, Nalagarh in district Solan over an area of 33 acres at a cost of Rs 33.66 crore under PPP Mode.  Keeping in view the factuality the Industry Department will provide for infrastructural facilities for speedy development of BT Park which in turn will provide employment to unemployed educated youth of the State.
It has been approved to extend the time period for submission of Detailed Project Report (DPR) in respect of Small Hydro Electric Projects upto 5 MW of capacity from 24 months to 36 months from the date of issuing consent letter for the projects in Lahaul and Spiti by amending the Hydro Policy.  Extension upto one year shall be permissible subject to payment of extension fee of Rs. 10,000 per MW per month.
It has also been decided to facilitate Himachalis who have been allotted HEP of 2 to 5 MW of capacity to allow them sale of 49 percent of their equity shares to Non-Himachalis at any stage after allotment of a project.  However, transfer/dilution of shares by Himachali allottee to Non-Himachali will be subject to the condition that the original allottee shall retain the controlling interest i.e. 51 percent equity in the new entity upto two years after actual commissioning of project.
It has been approved to allow change in location/elevation of 13 Small Hydro Electric Power Projects below the capacity of 5 MW.  The IPPs enhancing generation capacity by more than 20 percent shall be liable to provide 3 percent additional free power Royalty to the State besides Upfront Premium Pro-rata basis and capacity Addition.  Rate of Rs. 1.00 lakh shall be payable for enhancement upto 0.50 MW; Rs. 2.00 lakh for projects with enhancement in capacity between 0.50 to 1.0 MW and Rs. 5 lakh per MW for enhancement of over 1 MW capacity.
It has been approved to cancel 1.5 MW  Dholera Small Hydro Electric Project in district Kangra.
It has been decided to provide 4757.77 MT apple procured under Market Intervention Scheme – 2011 free of cost to HPMC for manufacturing of juice in different Units of the Corporation.
It accepted the proposal to convert 92 daily wage Patwaris as contract employees in the Department of Settlement.
It has been decided to hand over the possession of the Children Library in Children Park, Solan alongwith created posts to Education Department for operation and maintenance in future.
It has been decided to Amend the Recruitment and Promotion Rules of Child Development Project Officer in Social Justice and Empowerment Department.
 
2December,2011 Himachal Pradesh Cabinet in its Meeting held here today granted approval to the Eco-Friendly Organic Farming Policy to benefit small, medium and large farmers, by making efficient use of local/renewable resources, improve fertility of the soil, maximize circulation of plant nutrients and motivate farmers to avoid use of chemical fertilizers, pesticides etc.  Policy aims at providing support services to farmers switching over to organic farming.  Critical cadres of scientific manpower with knowledge of organic agriculture will be built up. Scientists of Dr. Y.S.Parmar University of Horticulture and Forestry, Nauni, Solan and Chaudhary Sarvan Kumar University of Agriculture, Palampur, will be carrying exhaustive research in organic farming besides introducing Diploma/Certificate Courses in Organic Agriculture. 
 Approval has been granted for the procurement of citrus fruits during the intervening  period from November 21, 2011 to February 15, 2012, under Market Intervention Scheme,  through 54 Procurement Centres   to be established in different areas and per  kilogram   procurement   price for Kinnow/Malta/Santra fixed at  Rs. 5.85; Malta for Grade B and Rs. 5.25  for Grade C  respectively. Galgal procurement price fixed at Rs. 4.15.  HPMC, HIMFED and HP Agro Industries Corporation will be designated agencies for procurement of the fruit.  Handling charges for Kinnow/Malta/Santra will be Rs. 3.50 per kg and Galgal Rs. 1.50 per kg.
Approval has been granted to the Draft Mukhya Mantri Grameen Parivahan Scheme to generate self employment to the educated unemployed youth by generating opportunities to operate transport vehicles on various routes,  besides providing transportation facility to the villagers who have so far not been availing the benefit of regular transport service.  Vehicle owners granted permits will be covered under Special Road Tax.  Private operators plying buses on routes not covered by HRTC buses and carrying pass holders will be eligible for financial incentives from the State Government.  29, 22 and 17 seater bus operators, on giving undertaking of carrying pass holders,  @ Rs. 2,200, Rs, 1,500 and Rs. 1,000 per month as financial incentive respectively from the State Government.  Unviable routes shall also be included on need basis.
Cabinet decided to enhance the superannuation of faculty members of Medical and Dental Colleges in the Medical Education Department in the State of Himachal Pradesh from existing 58 to 62 years.
It has been decided to make Rain Water Harvesting System from the roof tops of the buildings compulsory in the planning areas of the State by carrying amendment in the Himachal Pradesh Town and Country Planning  Rules, 1978 so that optimum use is made of the same for non-consumption purposes.
Draft Himachal Pradesh Disaster Management Rules, 2011 has also been granted approval.
Approval has been granted to the Amendment in fixation of circles rate for determining stamp duty and registration fee for sale and purchase of the land in the State.
It has been decided to accept the bid of M/s Ropeway and Resorts Limited, Kolkata, for execution of Palampur-Neugal Ropeway Project in district Kangra for construction of the same on BOT basis.
The selection  of 150 persons for the posts of Patwari candidates in Revenue Department.
It granted approval to fill up 100 posts of Junior Engineers in Public Works Department to strengthen the field work force in the department.
Approval has also been granted to fill up 20 posts each of the Surveyor and Steno-typists in Public Works Department through direct recruitment on contract basis.
It has been decided to regularize the services of 5 daily wagers working in HIMUDA as Peon/Chowkidar, on fulfillment of mandatory conditions.
Approval has also been granted to the  revision of the provisions in the Himachal Pradesh Land Record Manual for issuing computerized   certificates for various requirements and also simplify procedure for mutation.
Cabinet approved cancellation of MOU with Himachal Indage Limited for setting up of Wineries in Nagwain in district Mandi and Pragati Nagar in district Shimla forthwith.
It granted permission to put nine small mineral mines falling in Neugal Khad of Palampur in district Kangra to public auction.
Approval has been granted two  settlement of liabilities by HP Financial Corporation of to the Small Industries Development Bank of India (SIDBI) amounting to Rs. 67.15 crore on payment of Rs. 40 crore in 19 quarterly instalments.
It granted approval to changes in location/elevation in respect of   17 Small Hydro Power Projects as per the conditions laid down in the present Power Policy.
It has been decided to upgrade  the Institute for Disabled Children at Sunder Nagar to plus two level.  This will serve the hearing impared and visually impaired children..
It has been decided to open 5 Government Polytechnics in the districts of Sirmour, Bilaspur, Kullu, Kinnaur and  Lahaul and Spiti.
It granted permission to fill up vacancies of six Naib Tehsildars,  in the Revenue Department in Shimla Division through direct recruitment through HP Public Service Commission.
It granted approval to the Amendment in the Himachal Pradesh Motor Vehicles Rules, 1999 by incorporating provision that no vehicle owner shall paint or exhibit any particulars or insignia other than the registration mark in the Registration Plates of their vehicle.
It granted approval to the rationalization of Token Tax of public and private transport vehicles by amending the Himachal Pradesh Motor Vehicle Rule, 1999, Schedule-I aimed at checking traffic congestions and pollution problems.
It approved Amendment in Himachal Pradesh Registration of Societies (Amendment) Act, 2011, by bringing Sports Societies also into the ambit of the Act and raise the annual balance sheet limit from Rs. 5 lakh to Rs. 20 lakh for publication of the same in the newspapers and save the small societies from financial liabilities.
It has been decided to create one Irrigation and Public Health Division for Finna Singh Medium Irrigation Project at Sadhwan, Nurpur, district Kangra.
It has been decided to transfer ownership of PWD Rest House in Main Bazar, Hamirpur to  the local Municipal Committee.
 
18November,2011 Himachal Pradesh Cabinet in its Meeting held here today granted approval to Himachal Pradesh Public Services Guarantee Rules, 2011 aimed at providing time bound notified services to the people by different departments by maintaining transparency, accountability and responsiveness in the administration. The Rules guarantee delivery of notified public services to the citizens and penalize  the officials/officers in the case of delay for non delivery of services in critical departments such as Health, Forests, Panchayati Raj, Revenue, Industries, Irrigation and Public Health Department, Agriculture, Animal Husbandry, Social Justice and Empowerment Department, Home (Fire Services) MPP& Power, Urban Development and Town and Country Planning.  Every citizen, if eligible, shall have a legal right to demand that the notified public services are provided to him within the prescribed time limit.  In case the service is wrongfully denied or delayed, the applicant has recourse to remedial measures under the Act/Rules including monetary compensation and disciplinary action against the defaulting officials/officers.
It approved guidelines under Section 13(1) of the Right of Children to Free and Compulsory Education Act, 2009, to simplify the admission procedure to  educational institutions in the State and to ensure that all schools follow a system of random selection out of the applications received for admission in class I or pre-primary class as the case may be.  Each school should formulate a policy under which admissions will take place.  This Policy should include criteria for categorization of applicants in terms of the objectives of the school on a rational, reasonable and just basis.  There shall be no profiling of the children based on parental educational qualifications.  The Policy should be placed by the school in the public domain, given wide publicity and explicitly stated in the school prospectus.  There shall be no testing or interviews for any child/parent falling within or outside the categories and selection would be on a random basis.  Admission should be made strictly on above basis.
It has further been decided that all private educational institutions upto middle standard shall now be recognised by the Education Department instead of obtaining affiliation from HP Board of School Education.  Schools fulfilling prescribed norms shall be inspected by competent authorities within three months of the self declaration made by them which shall be published by respective District Education Officer/Deputy Director of Elementary Education within a fortnight thereafter. The renewal period for recognition shall of five years on payment of annual fee of Rs. 500.  Each of the self declaration and recognition application shall be admitted on payment of Rs. 5,000 for primary and upper primary schools, class I to V and VI to VIII and  Rs. 10,000 for schools having classes from I to VIII standard.
It agreed in principle to explore possibility of developing of Aerial Ropeway Transportation System for transportation of Apple from Apple Belt (Apple Growing Areas) in the State to prospective markets through Private Sector participation and initially get conducted a pre-feasibility study in the area, by appointing Consultant through open competitive bidding by Himachal Pradesh Infrastructure Development Board.  In the first instance the study may be limited to the major apple growing areas of Shimla district and the scope of work/terms and conditions of the assignment shall be finalised by the Board in due course of time.
It approved Guidelines for hiring services of Cook-cum-Helper under Mid Day Meal Scheme by the School Management Committee in the state owned educational institutions to ensure that the students are served nutritious, fresh and hygienic food on school days.
It has been decided to extend the date for submission of Annual Returns under Himachal Pradesh Value Added Tax Rules, 2005 to November 30, 2011 to facilitate the traders in filing their returns. 
It granted approval to the Recruitment and Promotion Rule for the post of Senior Lecturer (Pharmacy) (Class-I Gazetted) in the Department of Technical Education.
It sanctioned four gypsies to the Department of Forest, Farming and Environment in replacement of old vehicles.
 
9November,2011 Himachal Pradesh Cabinet in its Meeting held here today granted permission to open 198 Timber Depots on need basis besides re-opening 57 Imported Timber Depots, to market Imported Timber of the species which are not available in the State.  The decision has been taken in view of the timber requirement of the users which would go a long way in saving the forest wealth of the State.  It would also help in giving boost to self employment ventures of the people engaged in furniture manufacturing activities and reopen 301 furniture shops closed down since August 1, 2010.
It approved enhancement in the loan procurement limit of Himachal Pradesh State Electricity Board Limited from Rs. 4,000 crore to Rs. 5,000 crore and also provide guarantee to procure Bonds worth Rs. 1,200 crore from Banks and Financial Institutions.
It granted permission to permit use of distinctive flag by Chairman, Himachal Pradesh Finance Commission on his official vehicle and red beacon and distinctive flag by the Principal Chief Conservator of Forests (Wild Life) on the analogy of its counterpart in the State.
It approved continuation of 20 posts of Assistant Engineers upto March 31, 2012 in Public Works Department and granted permission for filling up of 8 posts of different categories on deputation and 4 posts on contract basis in the Department of Environment, Science and Technology;  5 posts of different categories in Himachal Pradesh Technical University on secondment basis and one post of System Analyst by outsourcing; one post of Assistant Director (Physics and Ballistics) in the State Forensic Laboratory, Junga through direct recruitment on contract basis;  besides upgrading the post of Senior Law Officer (Hindi) to Assistant Legal Remembrance and Under Secretary (Law) in the Department of Law.
It approved re-demarcation of jurisdiction of Nagar Panchayats of Rewalsar and Sarkaghat in district Mandi for planned and regulated development of the area.
It also approved renaming of Ropari Chowk and Ropari-Jaisinghpur road via Harot in district Kangra after Shaurya Chakra Awardee, Martyr Subedar Kehar Singh, and Bhatoli-Malyavar road in Ghumarwin, district Bilaspur after Vir Chakra Awardee late Shri Sukh Ram, who hailed from respective areas.
It granted approval to the amendment in the Himachal Pradesh Fire Department Uniform Rules, 2005 and Himachal Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 2008.
 
18October,2011 Himachal Pradesh Cabinet in its meeting held here today decided to check monkey menace more effectively by setting up 25 Monkey Sterilization Centres equipped with state of the art equipments to be manned by trained manpower to achieve sterilization target of  2 lakh monkeys by June 30, 2012 and provide cash incentive of Rs. 500 per monkey captured.  Forest Guards will also be eligible to reap benefits under the Scheme.  People feeding monkeys on wayside will be dealt with stern as per the prevalent legal provisions.  The Scheme will be implemented under the control of Wild Life Wing of Forest Department.
It was observed by the Cabinet that the judgement delivered by the Hon’ble Supreme Court of India on 11th October, 2011 in the case of Suraj  Industries Private Limited V/S State of Haryana and Punjab, declaring transfer of land through General Power of Attorney as illegal was a landmark judgement.  It has been decided to issue necessary instructions to all the Registrars and Sub-Registrars to implement the decision in letter and spirit and implement the provisions under Section 118 of the Himachal Pradesh Tenancy and Land Reforms Act, 1972 strictly.  Violation of the law laid down by the Hon’ble Supreme Court and the provisions of Land Reforms Act will be personal responsibility of the concerned Registrar/Sub-Registrar.
It approved enhancement in the daily allowance of Home Guard Volunteers from Rs. 170 to Rs. 200 benefitting 8,000 volunteers while those deployed in tribal areas will be getting 25 percent additional allowance.
With a view to preserve and honour the rich cultural heritage of the State it has been decided to declare Winter Carnival of Manali, district Kullu, as National Level Festival; Dussehra Festival of Jaisinghpur in district Kangra, as State Level Festival, Fateh Divas in Nadaun in district Hamirpur, Rishi Markandeya Krishak Vikas Avam Pashupalak Sayar Mela, of district Bilaspur, Historic Piplu Mela of Bangana in district Una and Ekadasi Mela Devthi, Majhgaon in district Sirmour as District Level Fairs.
It sanctioned creation and filling up of 8 posts of different categories in Civil Hospital, Nurpur in district Kangra,   7 posts of different categories in the Centre of Excellence in Dravya Guna and Medicinal Plant Project at Joginder Nagar under Department of Ayurveda, 5 posts of Lecturer/PGT (Commerce) in Backward Educational Blocks of Tissa, Mehla, Salooni, Pangi in district Chamba and Shillai in district Sirmour.  One post of Junior Analyst in Food, Civil Supplies and Consumer Affairs Department, is also allowed to be filled up on contract basis.
It granted permission to Import the Brands of IMFL (EDP) upto Rs. 2,000 per case and levy of lease/sub-lease fee on Distillery/Bottling Plant of IMFL located in the State of Himachal Pradesh.
It granted approval to construction of an Inspection Hut (Rest House) of Irrigation and Public Health Department at Thana Kalan in district Una.
It allowed change of ownership and possession of estate and 1771 kanal   landed properties from the name of Technical Education Department at Hamirpur to the name of National Institute of Technology, Hamirpur.
It has been decided to transfer the post of Editor Gazetteer from the Department of Language, Art and Culture to Revenue Department.
It approved issuance of the Letter of Intent in favour of Marketing Times Education Foundation, New Delhi to set up Dhauladhar Hills University in district Mandi.
It granted approval to Himachal Pradesh Legal Metrology (Enforcement) Rules, 2011, providing for renewal for 5 years in place of 2 years.
It granted approval to the Training and Examination Rules of Himachal Pradesh Subordinate Accounts Services (General Branch)
dggIt granted approval to the Recruitment and Promotion Rules for the post of Nursing Superintendent, Class-I, Gazetted in the Department of Health and Family Welfare.
 
10october,2011 Himachal Pradesh Cabinet in its Meeting held here today granted approval to execute an Agreement with Power Trading Corporation (PTC) India Limited to extend the validity by one year, from October 31st, 2011 to October 31, 2012, for sale of Government of Himachal Pradesh’s entitlement of free and equity share of power in all existing and upcoming hydro projects and authorized Principal Secretary (Power) to execute the Agreement on behalf of the Government of Himachal Pradesh with Power Trading Corporation India Limited. PTC shall ensure 100 percent scheduling of power with take or pay liability, obtain most competitive price at 100 percent scheduling, ensure optimal scheduling of power to minimize impact of Un-utilised Interchange (UI); undertake total accounting of Government of Himachal Pradesh power and for this purpose reconciliation of energy accounts with HPSEB Limited/HPSIDC shall periodically carried out to identify the quantum and rate of power governed under UI. Subsequently, reconciliation of payments shall also have to be carried out with the Directorate of Energy on quarterly basis. PTC shall take upon itself the payment obligation of the State Government towards SJVNL for equity power as well as payment of long term and short term open access charges and the UI claims beside ensuring fortnightly payment to the State Government irrespective of receipt/non-receipt of payment from the buyer utilities/customers, including HPSEB Limited.
It granted approval to notify revised minimum wages to the labourers working in private sector under Minimum Wages Act, 1948 from Rs. 110 to Rs. 120 and bring them at par with the labourers working in Government Sector.
It approved enhancement in the Honorarium (Samman Rashi) of the Freedom Fighters in the State from Rs. 4,000 to Rs. 5,000 per month.
It has been decided to formulate a Scheme to honour the officers and officials of different departments engaged in construction activities of various projects for achieving the completion target of the projects ahead of their scheduled time and for saving on estimated cost as well so that good workers are encouraged and time and money also saved.
It has been decided to decentralize the power conferred by section 8-A of the Himachal Pradesh Village Common Lands Vesting and Utilization Act, 1974 and authorize all the District Collectors/Deputy Commissioners to change pool of land vested in the State Government under the provisions of the said Act, strictly in accordance with the provisions of Section 8-A read with section 8 of the Act, ibid, in their respective jurisdiction so as to minimize the time taken in transfer of such lands.
Cabinet approved filling up of 16 vacant posts of Patwari candidates out of the trained candidates in Revenue Department on contract basis. Three Patwaris of district Kinnaur will be given option to opt for other district till the vacancies become available in Kinnaur.
It has been decided to regularize the temporary Weighing Barrier at Barotiwala in district Solan and sanction one post of Assistant Regional Transport Officer, one post of Senior Assistant, two posts Clerks and 3 daily wage Home Guards to man the same.
It accorded approval to the rates of High security Registration Plates for the implementation of Rule 50 of Central Motor Vehicles Rules, 1989 and Motor Vehicles (New High Security Registration Plates) Order, 2001. The new High Security Registration Plates will be tamperproof and non-removable and can only be affixed by the approved manufacturer in the presence of Registering Authority. The said Scheme will be applicable to the new vehicles in the coming month and two years of grace period is allowed to old vehicles which are already registered.
It granted approval to the Amendment in the Section 27 of the Punjab Excise Act, 1914 as applicable to the State of Himachal Pradesh and to issue ordinance thereof so that the owner of reputed brand could bottle their produce within the State of Himachal Pradesh. This will generate additional employment besides enhancing the revenue of the State.
It has been decided to declare the State Level Renuka Jee Fair as that of International Level.
It approved re-designation of the post of the Chief Architect in HP PWD as Architect-in-Chief.
It granted approval to the Recruitment and Promotion Rules of Section Officer (Class-I Gazetted), Accounts Officer (Class-I Gazetted) in Environment, Science and Technology Department; Principal Nursing Officer (Class-I Gazetted) in the Department of Health and Family Welfare.
 
24,September,2011 Himachal Pradesh Cabinet in its Meeting held here today decided to conduct Socio-Economic and Caste Census-2011 in the State in two phases from October 12 to November 17, 2011 in the case of Tribal Areas and from 14th November to 19th December, 2011 in non-tribal areas of the State as per the decision of the Government of India.  The Census would help in formulation of policies and programmes for the benefit of the weaker sections of the society as also identify the really deserving families to be covered under various poverty alleviation programmes of the Government.  Economic status of different sections of the society would also be ascertained and ineligible persons debarred from taking undue advantage of various social welfare schemes.
It granted approval to discontinuation of Board Examinations of plus one examination in the State and the same would be conducted by the Department of Education at its own level.
It decided to transfer the operation of 2,322 Rural Water Supply Schemes to local Panchayats authorizing them to engage Jal Rakshak (Water Guards) to undertake the smooth and regular supply of water and operational tasks where the expenditure would be borne under NRDWP allocations/State funds. 
It decided to renew the National Health Insurance Scheme (NHIS) for next three years from March 1, 2012 to February 28, 2015 besides bringing other eligible categories under the Insurance fold.
It granted approval to signing of Memorandum of Understanding between Tourism and Civil Aviation Department and Indian Railway Catering and Tourism Corporation to provide quality catering services in the newly opened Tourist Information Centres at Shimla (Bye-Pass), Solan, Nahan and Suketi in district Sirmour on competitive rates.   The State Government is creating a strong network of way side amenities where besides catering services local artifacts and gift items etc. would be made available to the tourists thereby creating retail outlets to the local people of the respective area and generate income avenues to them.
It approved amendment in the Himachal Pradesh River Rafting Rules, 2005 to adopt new Himachal Pradesh River Rafting (Amendment) Rules, 2011 and open Lahaul and Spiti area for river rafting water sports which till date are being organized in Kullu-Manali on river Beas and Tattapani on River Sutlej.  With the inclusion of Lahaul-Spiti district water sports adventurers would be able to experience virgin locations on the waters of Lahaul and Spiti valleys for such activities.  Since the construction work of Rohtang Tunnel is in progress and on completion the land locked Lahaul valley would be opened to the tourists all through the year and the river rafting would be an added attraction.
It approved construction of bus stands at Parwanoo, Hamirpur and Una, extend construction period from 12 to 18 months in the State on Public Private Participation (PPP) Mode and extend the concession period to 40 years, to all future projects, including bus stands under construction at Rohru and Palampur. 
It approved permanent absorption of 8 employees of different categories of AIPL and Agro Industries Corporation in Agriculture Department and allowed filling up of ten posts of clerks and three posts of Welfare Organisers in the Sainik Welfare Department besides elevating 29 Water Carriers to the post of Cook in Police Department by granting them one time relaxation in the educational qualifications of the candidates.  14 posts of different categories have also been created in the newly created departments of Scheduled Caste, Scheduled Tribe, OBC and Minorities and Women and Child Development Departments to make them functional on priority. It approved opening of Ayurvedic Health Centre at Bathara in district Shimla and setting up of a Fire Post at Amb in district Una.
It also decided to upgrade the 10 bedded Ayurvedic Hospital at Una to 30 bedded hospital.
It granted approval for revival of the post of Divisional Engineer (Soil Conservation) with a view to strengthen the agriculture sector.
It granted approval to the Draft National Land Acquisition and Rehabilitation and Resettlement Bill, 2011.
It granted approval to the amended Recruitment and Promotion Rules of  Joint Director (Agriculture) in Agriculture Department, Superintendant Grade-I (Gazetted Class-I) in the Department of Information and Public Relations and framed Recruitment and Promotion Rules for the post of Lecturer Engineering (Polytechnic) (Class-I Gazetted) besides approving  amendment in Recruitment and Promotion Rules for the post of Lecturer Applied Sciences and Humanities (Class-I Gazetted),  in the Department of Technical Education.
 
9 September,2011 Himachal Pradesh Cabinet in its Meeting held here today decided to adopt revised  guidelines regarding Local Area Development Fund (LADF) in relation to Hydro Power Projects.  The existing guidelines issued under the State Hydro Policy, 2006, needed change to address some gaps and difficulties being faced by the local areas, power producers and district administration.
The most important feature of the new guidelines is a provision for the manner in which 1 percent free power to be made available by the power producer in addition to the 12 percent free power to the State Government, shall be allocated.  This one percent free power will be distributed annually as a cash transfer to every family in the project affected area of the project to the extent of 85 percent.  The balance 15 percent will be distributed as addition to all the BPL families in the project affected area.  This cash transfer to each family will be based on the receipts from sale of the free power by the Directorate of Energy every year.  It will result in life long benefit to all the families in project affected areas.  It sis expected that this will give boost to hydel project development by creating a direct interest amongst local stake holders in the project completion.  It is for the first time that such a step has been taken by any State in the Country and it is in keeping with the best practices of benefit sharing internationally.
Among other changes brought out about its revision in the Local Area Development Fund Guidelines is a concept of separate Committees under the district administration for each project with the project developer as Member Secretary instead of one Committee for the entire district.  Concerned MLA shall be represented on all these Local Area Development Committees.  The guidelines enhance the autonomy of Gram Panchayats to decide on schemes to be taken up out of the initial funding to Local Area Development Fund and in the selection of implementation agencies.  They clarify the concept of project affected area and project affected zone and make a provision of normative allocation of funds for schemes in the project area during construction of a project.  For smaller projects, care has been taken to ensure that wards of Gram Panchayats alone can be defined as Project affected areas so that funds are not spent in other places.  The flexibility of number of instalments and timing of contribution to Local Area Development Fund in the existing guidelines has been removed and a classification based on project size has been introduced to impart a clear focus to Committee functions, schemes that can be taken up and the people who can benefit.
It has been decided  launch ‘Mukhya Mantri Adarsh Gram Yojna’ (Model Village), aimed at integrated development of selected two villages in each of the Assembly Segment  the State having more than 40 percent Scheduled Castes and Scheduled Tribes population (a minimum of 200 souls), to create infrastructural facilities of road network, water supply, sanitation and street lights etc..   Rs. 10 lakh will be provided for infrastructure development to each assembly segment under the Scheme, in addition to regular budget provisions, and,  all other government activities/schemes will be converged to ensure that  it becomes a model of development.
It granted approval to the revised Service Charges of Government Services under Lok Mitra Project in the State.   Revised Service Charges for electricity bill collection would be Rs. 5 per domestic bill to be shared by consumer and Board equally; for Nakal Jamabandi charges would be Rs. 10 per page to be borne by the applicant while redressal of grievance/demand through e-Samadhan  would be charged at Rs. 10 per page to be borne by the citizen.  Provision of additional G2C services will also be available at Lok Mitra Kendras.
It granted sanction to create 40 posts of Junior Coach in Youth Services and Sports on contract basis and re-designate two posts of Life Safe Guard-cum-Coach and one post of Sports Coach as Junior Coach to give renewed momentum to the sports activities in the State, especially in rural areas and 28 posts of different categories in the office of Advocate General, Himachal Pradesh.   4 posts of Principal (College Cadre to be filled up on direct recruitment basis) in Higher Education Department through HP Public Service Commission.
It granted approval to convert 8 B.Ed. qualified EGS Instructors as Gram Vidya Upasak (EGS).
It approved relaxation of 5 percent in the minimum qualifying marks to the SCs/STs, OBCs and Handicap categories of candidates in State Teachers Eligibility Test.
It granted approval for construction of multi-storey parkings at Chhota Shimla, Sanjauli and Lift  of capital town of Shimla, facilitating parking  of   250, 388 and 700,  respectively, total capacity of 1,338 vehicles.  It would go a long way in easing traffic congestion created by road side parking in the town besides catering to the parking requirements of vehicles entering the capital town from different directions. 
It approved new Recruitment and Promotion Rules of Assistant Director/Assistant Controller (Gazetted—Class I) in Finance Department.

18 August,2011 Himachal Pradesh Cabinet in its meeting held here today decided to  expand the scope of Integrated Scheme for Persons with Disabilities under  ‘SAHYOG’ by making the same more beneficial to the eligible physically challenged persons and provide them better facilities of Scholarships, Vocational Training and enhancing Incentives for Marriage etc.. Funds shall be provided for research and development projects on disability down to block level through various organizations and NGOs besides Universities and Medical Colleges.  It has been decided to enhance Scholarship amount to the eligible disabled and provide Day Scholars scholarships ranging between Rs. 350 to Rs. 750 per month and Boarders Rs. 1,000 to Rs. 2,000 per month.  The income limit to avail scholarship benefits has been enhanced from Rs. 60,000 to Rs. 2.5 lakh per annum to bring more people under the fold of the Scheme.  Marriage incentives of disabled persons have also been enhanced substantially.  Now marrying a disabled with 40 to 74 percent disability the spouse would get Rs. 15,000 instead of Rs. 8,000 as incentive and others with 75 to 100 percent disability the incentive amount has been enhanced from Rs. 15,000 to Rs. 25,000. In case of couple with disability both of them will be eligible to get the incentives.   Outstanding NGO doing commendable job in the field will also be awarded a cash prize of Rs. 10,000 and a citation.
It granted permission to recruit 1,293 JBT qualified teachers from 12 DIETs of the State and 20 Teachers Training Course qualified candidates from St. Bede’s College of 2008-10 batch, as per the existing Recruitment and Promotion Rules and following the reservation roster including that for ex-servicemen, on contract basis.
It granted approval to construct Bus Stands at Rohru and Palampur with multi-storey parking and Shopping Mall under PPP Mode.  In future the concession period in such projects would be 40 years.
It approved the proposal to exempt ‘Aerial Rope Way’ for 5 years from payment of Entertainment Duty from the date of commercialization and to reduce Entertainment Duty on Aerial Rope Ways from existing 25 percent to 15 percent besides bringing DTH under the ambit of Entertainment Duty.
It accepted the proposal to cancel allotment of the four Self Identified Mini Hydro Electric Projects for non-compliance of the laid down norms under the Power Policy of the State.
It also approved amendment in Section 26 in the Himachal Pradesh Excise Bill, 2009.
It restored the 10 Bedded Hospital status to Government Ayurvedic Health Centre at Sulyali in tehsil Nurpur of district Kangra.
 
8 August,2011 Himachal Pradesh Cabinet in its meeting held here today decided to launch the ambitious ‘Mata Shabri Mahila Sashaktikaran Yojna’ in the State and provide 50 percent subsidy to 5,100 eligible women of scheduled caste category belonging to BPL families against the proposed target of 5,000, on purchase of LPG Gas connection thereby relieving them from collecting fuel wood for cooking purposes and save forests of the State.
It has been decided to launch  a scheme for providing alternate self-employment opportunities to sex workers in the State and name the same suitably.  The Scheme aims at providing them vocational training to make them self dependent; rehabilitate through Skill Development Initiative Scheme (SDIS) based on Modular Employable Skills by a network of it is identified by the Department of Technical Education; assist in securing loans for establishing self-employment ventures to women trained under the Scheme; provide back-ended capital subsidy on loans provided through HP “Mahila Vikas Nigam” and to arrange retail outlets for the products manufactured by them. 
It granted approval to the introduction of  Himachal Pradesh Special Court Bill, 2011 and include attachment of disputed property of the accused acquired through corrupt means,  during trial period of the case, and lay the same on the floor of the House during ensuing Monsoon Session of Himachal Pradesh Legislative Assembly.
It granted extension to non achiever of established milestones IPPs executing hydro electric projects in different parts of the State,  on payment of extension fee of Rs. 10,000 per MW per month with a view to enable IPPs obtain clearances and start construction work within the permitted time frame with no further extension thereafter.
It granted sanction to open  Primary Health Centres at Churag, in Karsog Sub-Division of district Mandi;  Guru Ka Lahor in district Bilaspur; Bheri in district Kangra and upgrade Community Health Centre at Manali to Civil Hospital (50 bed capacity) and sanctioned 12  posts of different  categories to make the same functional.
It sanctioned 22 posts of different categories to make newly sanctioned Industrial Training Institutes at Khundian in district Kangra and Dalash in district Kullu  to make both of them functional on priority.
Cabinet approved Amendments in the Himachal Pradesh Taxation (on Certain Goods Carried by Road) (Amendment) Bill, 2011; Himachal Pradesh Passengers and Goods Taxation (Amendment) Bill, 2011; Himachal Pradesh Tax on Luxuries (in Hotels and Lodging Houses) Bill, 2011, providing  traders facility of e-filing of their returns and e-payment of tax and approved draft of  Himachal Pradesh Tax on Entry of Goods into Local Area Act, 2011, for laying the same on the floor of the House during forthcoming  Monsoon Session of HP State Legislative Assembly for approval.
It decided to provide an opportunity to class IV employees of different departments seeking promotion to Class III, to quality type test on computer instead of manual typewriter.
It granted permission to Coastal Projects Limited to set up a stone crusher in mohal Katinda, tehsil Jubbal, district Shimla to supply grit to Sawra-Kuddu Hydro Electric Power Project as a special case.
It granted approval to the implementation of Food Safety and Standard Bill, 2011.  The designated officers in the district shall function under the overall supervision of District Magistrate/Collector of the district concerned.
It approved Amendment in Document Writers Licensing Rules, 1971 with a view to generate employment avenues to more educated unemployed youth in the State.
It approved Amendment in the Himachal Pradesh Land Revenue Act, 1954 and Himachal Pradesh Appropriation (No. 3) Bill, 2011 for laying in ensuing Monsoon Session of Himachal Pradesh Legislative Assembly.
It repealed the existing Recruitment and Promotion Rules of the Assistant Professor (College Cadre) of Government Degree Colleges in Higher Education Department; Assistant Professor (Computer Engineering) Class-I (Gazetted) in Jawaharlal Nehru Government Engineering College, Sundernagar; Deputy Director (Statistics) Class-I (Gazetted)  in the Department of Animal Husbandry. 
It sanctioned one car to Land Acquisition Officer, Shimla, to facilitate frequent field visits.
 
27July,2011 The Grant of permission under section 118 of land by non-agriculturists in Himachal Pradesh has been a matter of public debate and has also been raised in the Hon’ble High Court.  The Cabinet which met here under the Chairmanship of Prof. Prem Kumar Dhumal, Chief Minister, approved Amendments in Rule 38-A(a)(2) of the Himachal Pradesh Tenancy and Land Reform Rules, 1975 with a view to:

i)                 Bring in guidelines to ensure only eligible persons acquire land within strict limits and after due diligence to ensure it is appropriate for the concerned purpose.

ii)                Plug loopholes resulting in excessive revenue loss, and

iii)               Curtail discretion in the grant of permission

iv)       Ensure that persons living in Himachal Pradesh from generation to generation will not face any hurdle in securing permission for acquiring land for a dwelling unit or shop.

The amended Rule provides that for all purposes, other than for a dwelling unit or shop, any non-agriculturist seeking to acquire land with permission under section 118, shall need an essentiality certificate (EC) from the concerned Department that will certify his eligibility, clearly state land required is as per norms and that NOCs from all relevant departments and authorities including Local Bodies have been obtained.  In effect, for certain purposes like agriculture/horticulture use where no EC was required, this has been brought in and in cases like tourism and industry, relaxations with regard to NOCs have been removed.
In the case of permission for purchase of land for dwelling unit, the permission will be given only to person living and working in Himachal Pradesh prior to 1972 to persons working in Himachal Pradesh for over 30 years and duly recommended by concerned local body and to employees possessing bonafide Himachali Certificate, to Gallantry or Padma Award Winners and to persons who have achieved eminence in the sphere of health, education, culture, research, public service, sports and business and are recommended by a Committee of Principal Secretaries.
In the case of built up houses and flats, Section 118 is not attracted in case of lease upto 99 years.  Consequently many transactions are occurring for flats and storeys in buildings on 99 year lease.  These are registered at a fraction of the cost of transfer by sale.  The amended Rules will allow for transfer by sale of such properties provided they are registered with the Town and Country Planning Department.  This will enable the full stamp duty to be realized on these transactions.
These amended Rules and streamlined procedure will bring relief to both long term residents of Himachal Pradesh and outsiders, by clarifying the position on the situations where permission will be granted and where it will be refused.
It was decided to repeal the HP Pre-Emption Act, 2010, which has been attracting widespread criticism for holding up transactions relating to sale of land.
It has been decided to amend the HP Land Revenue Act, 1954, to provide for:

i)                 Service of summons by way of publication in newspaper in case service can not be affected at known address (this will facilitate speedier disposal of revenue cases, specially partition cases).

ii)                Option of having mutation based on documents, entered and attested at Tehsil/Sub-Tehsil level instead of in Patwar Circle.  This will facilitate immediate mutation of registered sales and other transactions and provide relief to persons residing away from Patwar Circle due to employment or other reasons.

It was decided to amend the HP Ceiling of Land Holding Act, 1972, to increase the ambit of activities qualifying for exemption from ceiling limit.  Currently this is available only for hydel projects, industry and tea gardens.  Given the expanding scope of economic, social and cultural activities, it is proposed to extend this to IT Parks, BT Parks, Tourism Units, religious or spiritual organisations and bodies or organizations active in the sphere of education and sports.  This Act once passed by the Vidhan Sabha will be sent to Government of India for the assent of the President of India.
The Cabinet also considered the HP Lease Rules relating to Lease of government land to rectify the shortcomings and defects pointed out by government departments, public and concerned organisations.    The new Rules streamline purposes for which lease can be granted so as to restrict it to public purposes of infrastructure, social and cultural activities and those with a location specificity such as hydel projects, ropeways etc..  The Lease rates have been standardized to 5 percent for a 99 year lease and 3.5 percent for lease upto 40 years, with a provision for periodic revision.  Sub lease of shops in bus stand areas, parkings, etc. have been provided for to enable such infrastructure to come up on a self sustaining basis.
The Cabinet also approved two amendments in the Registration Manual.  The First one does away with the requirement of an identifier where the persons seeking to register a document possesses a photo identity card of a category notified by the Government.  The Second one seeks to prevent cash dealing by registration clerks in revenue offices to avoid the kind of incident of embezzlement that took place in Paonta Sahib recently. It has been approved to present photo identity proofs of PAN Card; ADHAR Card; Photo Identity Card issued by Central or State Government Department or a Central or State Government Undertaking; Valid Passport; Driving License (with photo); Photo Debit/Credit Card or Electoral Identity Card,  in original by an executant or an identified to meet the requirements of Section 103 of the Registration Manual.  This will be in addition to the existing system of identification.
It has been approved to enhance the taxable quantum from Rs. 2.00 lakh to Rs. 4.00 lakh in respect of small traders like halwai, dhaba owners and similar other catering houses of small scale as also introduce electronic facilities to the traders in the State to help them file their returns etc. conveniently by amending the Value Added Tax Act. 
It approved creation of Himachal Pradesh Police Fund for utilization in  improvement of traffic system/traffic signals and installation/maintenance of electronic equipments such as CCTV etc.   For this, an amount of Rs. 83 lakh stands allotted to the Police Department.
It granted sanction to create 12 posts of different categories to make the 4th State Finance Commission functional, 15 posts of technical and non-technical categories for State Load Dispatch Centre and fill up nine posts of Junior Auditors through direct recruitment by the Local Audit Department by carrying recruitment of three Junior Auditors in each of the coming three years.
It granted sanction to construct one new Rest House by Public Works Department at Nandpur village in Tehsil Jubbal in district Shimla to facilitate convenient movement of field functionaries.
It approved 25th Annual Report of Lokayukta Himachal Pradesh for the year 2010 for presenting the same in the forthcoming Monsoon Session of Himachal Pradesh Legislative Assembly.
It approved Recruitment and Promotion Rules for the post of Deputy Legal Remembrancer-cum-Deputy Secretary (Law)  (Class-I-Gazetted).
It sanctioned one Scorpio in replacement of the old condemned vehicles for Animal Husbandry Department.
 
18July,2011 Himachal Pradesh Cabinet in its Meeting held here today decided to implement Market Intervention Scheme for Apple fruits to ensure growers remunerative price of their produce in various terminal markets and check their exploitation at the hands of middlemen.  It has been decided to procure ‘C’ grade apple fruits @ Rs. 5.25 per kg. under the Market Intervention Scheme  with effect from July 20 to October 31,2011 through 259 apple procurement centres and HPMC, HIMFED and HP Agro Industries Corporation would be designated procurement agencies.
It authorized Principal Secretary (Tourism and Civil Aviation) to the Government of Himachal Pradesh to sign the Loan Agreement on behalf of the State Government of Himachal Pradesh with the Asian Development Bank authorities and procure $ 95.16 million for developing tourism infrastructure for the State.
It decided to implement the condition of 15 percent release of water immediately down stream of diversion structures of Hydel Power Projects in the State vigorously and for the purpose of determination of minimum discharge, the threshold value of not less than 15 percent of the minimum inflow observed in the lean season shall be considered.
In view of the report of Himachal Pradesh State Electricity Board Limited, discrepancy of elevations, preliminary stage of the 261 MW Yangthang- Khab Project, socio-economic aspects, local preference, environmental concerns and the technical suitability of sites, the domain of the project has been granted approval by the Cabinet to FRL - 2,763, TWL - 2,537 meters and Gross Head 226 meters as against the allotted domain of FRL - 2,805 TWL – 2,600 meters and Gross Head 205 meters.
Cabinet granted approval to introduce a Bill called ‘The Himachal Pradesh Public Services Guarantee Bill, 2011’ before the Himachal Pradesh State Legislative Assembly during ensuing Monsoon Session aimed at bringing about transparence, accountability and responsiveness in the administration.  The proposed Bill will provide guarantee of the delivery of basic public services to the citizen within a stipulated time frame and sets in place an accountability mechanism for non delivery of notified services.
It approved regularization of 219 class IV daily wagers in Irrigation and Public Health Department, who have completed 8 years of service, 240 working days in each year, by granting them one time relaxation in educational qualifications.
Cabinet granted approval to forwarding Amendment proposal of Himachal Pradesh Lease Rules, 1993, to the Cabinet Sub Committee already constituted for the purpose for considering changes in the Himachal Pradesh Tenancy and Land Reforms Rules, 1975, and give its recommendations over the same.
It has been decided to provide electronic facilities to the traders in the State by amending the Himachal Pradesh Value Added Tax Rules, 2005 which will facilitate them in quick filing of their returns without hassles.
It sanctioned 30 posts of Junior Engineers (Civil, Mechanical and Electrical) to be recruited through the Himachal Pradesh Subordinate Services Selection Board in Irrigation and Public Health Department; 9 posts of different categories in the Drugs Control Wing, one post of Statistical Assistant in Municipal Council, Sundernagar; one post of Principal, 3 posts of Training Instructors and 2 posts of Clerks in the Panchayati Raj Training Centre coming up at Thunag in district Mandi.
It approved one time relaxation in the prescribed age limit as a Special Case in favour of 9 applicants for the post of pharmacists in Health and Family Welfare Department.
It approved Amendment in the Recruitment and Promotion Rules of Excise and Taxation Officers.
 
8July,2011 Himachal Pradesh Cabinet in its Meeting held here today decided to provide 8 kgs. of wheat/wheat flour and rice per person to all ration card holders residing in tribal and backward areas (Dodra Kwar area of district Shimla and Bara Bhangal area of district Kangra), in relaxation of the norms of Public Distribution System of providing 35 kgs. of ration per family per ration card holder during the period of July 1, 2011 to June 30, 2012.
It approved ‘Protsahan Chhatravriti Yojna’ for all categories of students travelling a distance of over 5 kms. daily  to attend  government schools from their permanent residences.  Every eligible student covering a distance of 5 to 8 kms. daily will be eligible to get scholarship of Rs. 200 per month while others travelling over 8 kms. to get Rs. 300 scholarship per month.  The Scheme is likely to benefit 22,500 students.
It granted approval for the policy to take over all 95 percent government aided private schools or staff under government control subject to fulfillment of the stipulations therein.
It approved hike of Rs. 300 in the monthly remunerations of the Tailoring/Embroidery Teachers serving at gram panchayat level centres,  by increasing the same from existing Rs. 1100 to Rs. 1400 per month benefitting 2095 teachers in the State.
It approved the recommendations of the Committee constituted to determine the transportation rates for ACC, Brmana, Gujrat Ambuja Cements, Darlaghat, JP and Ambuja Cements, Nalagarh and approved transportation rate of Rs. 27.20 per quintal for initial distance of upto 40 KMs and Rs. 68 paise per quintal for every additional kilometer beyond 40 KMs. distance.
Cabinet decided to constitute a Cabinet Sub-Committee to give its recommendations with regard to carrying amendment in the Himachal Pradesh Tenancy and Land Reforms Rules, 1975.  Shri Gulab Singh Thakur, PW and Revenue Minister will be the Chairman of the Committee while Shri Ravinder Singh Ravi, IPH Minister, Shri Kishan Kapoor, Industries Minister, Dr. Rajiv Bindal, Health Minister, Shri Jai Ram Thakur, Panchayati Raj and Rural Development Minister and Shri Mahender Singh, Transport Ministers will be its Members  and Financial Commissioner (Revenue) will be Secretary of the Committee.
Cabinet approved amendment in the Part Time Water Carrier Recruitment Policy 2009 to fill up 966 vacancies in Higher and Elementary Education Department on monthly remuneration of Rs. 1200.  It has been decided to include BPL also with SC/ST/OBC and constitute selection committees under the Chairmanship of concerned Sub-Divisional Magistrate.
It approved the recommendations of the Committee constituted under the Chairmanship of Principal Secretary (Transport) to the Government of Himachal Pradesh to give its recommendations on use of Red/Blue  lights on vehicles and decided to also allow Additional Commissioner and Joint Commissioner of Income Tax to use red light on their vehicles.
It approved in principle financial model, concession period, bidding parameter and RFP for construction of bus stands under PPP mode.
It approved amendment in planning upcoming ISBT  Complex at Tuti Kandi, Shimla.
It approved bifurcation of Librarian Cadre and approved Recruitment and Promotion Rules of the Librarian (College) Cadre and Librarian, Public Library (State Cadre).
It approved fresh rules for Lecturers ( College Cadre) in Government Sanskrit Colleges under Higher Education Department of the State by relealing the existing Recruitment and Promotion Rules.
It approved amendment in Common General Direct Recruitment and Promotion Rule for the posts of Steno-Typists (Junior Scale) and Stenographers (Senior Scale) in different departments of the State Government.
 
27 June,2011 Himachal Pradesh Cabinet in its Meeting held here today decided to reduce VAT on Diesel from 14 percent to 9.70 percent  and zero VAT on kerosene with a view to provide relief to the consumers from the recent price hike made by the Centre  on Petroleum products.
State Government has been implementing Marketing Intervention Scheme for Mango fruits so that the growers may get remunerative price of their produce in various terminal markets and to ensure that the exploitation by middlemen in the trade is checked.  The State Government has decided to procure ‘seedling’ and ‘grafted’ varieties of mango fruit @ Rs. 4.60 and Rs. 5.25 per kg.  respectively during the year 2011.  This scheme will be implemented in the State with effect from 1.7.2011 to 15.8.2011 and HPMC, HIMFED and HP Agro Industries Corporation would be designated procurement agencies.  34 mango fruit procurement collection centres would be opened which, if need be, will be increased as per the demand.
Cabinet approved Policy Guidelines to provide compensation to the farmers for damage to their crops during construction activities by Hydro-Electric Projects in the State as relief and rehabilitation measure.
Cabinet decided to incorporate one female Member in the State Review Board constituted to consider cases relating to Pre-Mature Release and Mercy Petitions of the prisoners as also consider the cases relating to convicts undergoing life and short term imprisonment.  It approved four cases for pre-mature release and two cases of mercy petition to forward the same to HE the Governor for approval.
In fulfillment of the announcements made by the Hon’ble Chief Minister, Cabinet granted approval to opening of 7 Ayurvedic Health Centres in the State.  The new Centres will be opened at village Viyunt Shardaghat in district Shimla; village Samtehan, GP Tarsooh (Gwalthai) in district Bilaspur;  village Khaggal, GP Neri in district Hamirpur; village Dugilag, tehsil Manali in district Kullu; village  Tanbol, in district Bilaspur; village Arki in district Solan and village Lounga, GP Thanadhar in district Shimla.  Permission was granted to make all of them functional by creating and filling up the  four posts of Ayurvedic Medical Officers on contract basis.
Cabinet agreed in principle to execute Inter-State Memorandum of Understanding and approved the draft for setting up of ropeway between Sri Anandpur Sahib (Punjab) to Sri Naina Devi ji (Himachal Pradesh).
Cabinet approved Amendment in the Recruitment and Promotion rules of Himachal Pradesh Forest Services (HPFS) (Assistant Conservator).  It also approved fresh Recruitment and Promotion Rules for the post of Reader-cum-Ahalmad (Gazetted ) Class-I; System Analyst (Gazetted) Class-I; Section Officer (Gazetted) Class-I and Private Secretary (Gazetted) Class-I,  in the Himachal Pradesh State Information Commission.
 
18 June,2011 Himachal Pradesh Cabinet in its Meeting held here today granted approval to ‘The Himachal Pradesh e-Stamping Rules, 2011’ for implementation in the State to collect stamp duty electronically in addition to physical pre-printed stamp papers for greater convenience and accountability. Authorized Collection Centres will be set up for collection of stamp duty. The new system will benefit the customers by fast deposit of money getting their documents registered under one roof and avoiding repeated visits to Treasury and Bank or Stamp Vendors. It will help in checking the pilferages.
 
Cabinet approved the mechanism for running of ‘Himachal Seva Sadan’ being constructed at a cost of Rs. 10.50 crore, in Sector 25, Chandigarh, consisting of 23 double bed suites, attached toilets and kitchenette, 15 six bedded and 3 number 3 bedded dormitories (total 99 beds) besides one transit room of 6 bed capacity, completely air-conditioned, to facilitate the patients and their attendants visiting Chandigarh for treatment in PGI etc. with quality boarding and lodging facilities at reasonable costs.
 
It granted sanction to create 8 posts of Assistant Engineer (Civil) in Irrigation and Public Health Department on regular basis. Adequate number of posts were approved to make Himachal Pradesh Private Education Institutions Regularity Commission functional.
Cabinet also granted approval for creation of 23 numbr of posts of teaching and non-teaching categories for Government Polytechnic, Talwar, in Jaisinghpur Sub-Division of district Kangra.
Cabinet granted approval for renewal of Smart Cards under National Health Insurance Scheme upto February 28, 2012.
Negotiation Committee was approved for expeditious acquisition of private land for Indo-Tibetan Border Police to raise a battalion of National Disaster Reserve Force in Mohal Uprid, Mauja Kopra, Tehsil Nurpur, District Kangra was also approved. It was also decided thatsimilar Negotiation Committees will be constituted for all Departments to deal with similar cases.

The Cabinet also approved rationalization of Entry Tax whereunder all Industrial inputs will now be taxed at a uniform rate of 1 percent.

 
26 May, 2011 Himachal Pradesh Cabinet in its Meeting held here today decided that henceforth all the Ministers alongwith concerned Secretaries would convene regular monthly Press Conferences to highlight the programmes and achievements of the State Government in their respective departments.
 It granted permission to reduce capacity of Shalvi Small Hydro Power Project from 7 MW to 4.75 MW and transfer the project to HIMURJA for execution.
 It granted permission to extend the period of Shah Nehar Project Division, Chandran, district Kangra, alongwith its three Sub-Divisions from March 31, 2011 to March 31, 2012 as also transfer one Sub-Division Anuhi from Siddhatha Medium Irrigation Project to Nurpur to undertake execution of Finna Singh Medium Irrigation Project in district Kangra.
 It also permitted filling up of two posts of Drug Inspectors in Health Department on contract basis.
Cabinet accepted the Parking Development Plan of Shri Guru Singh Sabha Gurudwara in Up-Mohal, Krishna Nagar, Cart Road, Shimla.
 It sanctioned one Mahendra Bolero Jeep in replacement to the old Gypsy to Sub-Divisional Magistrate, Paonta Sahib in district Sirmour, for more mobility and one Scorpio for Director Sainik Welfare, Himachal Pradesh, Hamirpur.
It approved amendment in the H.P. Allotment of Government Residences (General Pool) Rules, 1994.
 It also approved pitch a stone in the memory of Shaheed Kehar Singh at Government Middle School, Ropari in Tehsil Jaisinghpur, District Kangra.
Himachal The Cabinet also decided to constitute a Committee of Officers, including Aviation Experts to consider and  recommend the appropriate course of action to meet the helicopter needs of the State Government
 
9 May, 2011 Himachal Pradesh Cabinet in its Meeting held here today decided to recruit 5,000 teachers of different categories in various educational institutions of the State, in fulfillment of the Budget Assurance given by Prof. Prem Kumar Dhumal, Chief Minister, in the HP Legislative Assembly, while presenting the Budget Estimates for current financial year, 2011-12.  It further decided to introduce Informatics Practices as compulsory subject in the arts stream and as optional subject in other streams in the Government Senior Secondary Schools and to create 970 posts of Post Graduate Teachers to teach the subject through rationalization.
It approved to compensate the farmers of Una and adjoining districts on account of the loss caused in wheat production by high incidence of Yellow Rust on different varieties of PBW-343 and PBW-502.
It decided to bring about uniformity in the salary and commission of all the 528 bus conductors (Bus Sahayaks) deployed with HRTC and JNNURM buses and provide them Rs. 2000 per month as retaining fee with 2 percent commission thereby ensuring a minimum of Rs. 3,500 to each of the bus conductors. It granted approval for filling up of 307 posts of Class IV in all the Deputy Commissioner and its subordinate offices in the State by secondment from the surplus pool.
It granted permission to fill up 15 posts of Extension Officer (Industries) on secondment basis from HP State Financial Corporation.
It decided to absorb 137 employees of closed Nahan Foundry in different departments of the State on secondment basis.
It sanctioned 7 posts of teachers and 7 posts of non-teachning staff and to fill up on contract basis except for 2 posts of peon and one post of chowkidar which will be filled up from surplus pool and the post of sweeper will be filled up by outsourcing to make the newly sanctioned Government Degree College at Haripur Dhar in district Sirmour functional.
It approved  enhancement  of borrowing limit of HP State Electricity Board Limited from Rs. 3000 crore to Rs. 4,000 crore.
It approved change in elevations and capacity enhancement in 23 small hydro electric projects and to charge the Free Power Royalty etc. in accordance with the Power Policy  where the capacity enhancement is more than 20 percent.
Cabinet decided to allow IPPs to dispose off the power from the Project(s) after allowing royalty in the shape of free power to the State Government, in any manner they like in accordance with the provisions contained in the Electricity Act, 2003 and the rules and regulations made there under.  In case of projects where capacity enhancement has already been approved, the IPP, who have already signed the Implementation Agreements with the different clause of mode of sale of power, will be at liberty to sign open access clause hereafter subject to above conditions.
It decided to sell free power share in Karchham-Wangtoo Hydro Electric Project through Power Trading Corporation till the project starts regular generation.
It granted approval to lease out State owned outdoor stadium at Nurpur for development as Cricket Stadium to the Himachal Pradesh Cricket Association for maintenance and operation activities for a period of 30 years and  further granted approval to lease 1.61 hectares of land at Mohal Gumma, Tehsil Kotkhai, District Shimla of HP Youth Services and Sports Department to the Himachal Pradesh Cricket Association for development as Cricket Stadium.
It approved the Himachal Pradesh Private Educational Institutions (Regulatory Commission) Rules, 2011.
 
 
25 April, 2011 Himachal Pradesh Cabinet, which met here  today, decided to construct modern bus stands at Hamirpur, Chintpurni, Una, Baddi, Parwanoo, Manali and Dhalli in Shimla on Design, Build, Operate and Transfer  (DBOT)  basis under PPP Mode and approved the  financial model, concessionaire period, bidding parameters and Request for Proposal (RFP) for Development of Modern Bus Terminus and Commercial Complex document for execution of the proposed projects.
 Cabinet decided to continue with present policy of cost subsidy and transport subsidy on fertilizer.  It decided to initiate effective and concrete steps to promote organic farming amongst agriculturists and horticulturists of the State.
It granted approval to recruit 150 Supervisors in the Social Justice and Empowerment Department on contract basis and 37 posts of different categories to make the Atal Bihari Vajpayee Government Institute of Engineering and Technology at Pragati Nagar in district Shimla functional on priority.
It sanctioned Rs. 1,27,56,689 for purchase of 11 number of chassis for Advance Water Tender vehicles and 3 Quick Response Vehicles/Mini Water Tenders, to strengthen the fire fighting network in the State and equip the Fire Services Department with latest machinery and equipments.
It approved upgradation of Veterinary Dispensary, Lohardi (Chhota Bhangal) in district Kangra to Veterinary Hospital and fill up the vacancies through internalization.
 It approved Recruitment and Promotion Rules of Personal Assistants in all the Departments of the State Government.
8 April, 2011 Himachal Pradesh Cabinet in its meeting held here today decided to increase the honorarium of part time water carriers in  Education Department from Rs. 1000 to Rs. 1200 per month with effect from 1st April, 2011. This follows budget announcement made by the Chief Minister in his budget speech  for the year 2011-12 in Vidhan Sabha  on 9th March, 2011.
The Cabinet approved grant of salary during leave period to teachers, lecturers, Primary Assistant Teachers, Gramin Vidya Upasaks and para teachers appointed on contract basis  from academic session 2011-12. This is also budget announcement made by the Chief Minister while presenting the budget. As many as 12385 teachers would benefit from this decision of the Government which would have financial implication of Rs. 24 crore on the State exchequer annually.
The Cabinet after discussing the proposal of Health Department decided to fill up 150 posts of doctors on regular basis and also gave approval to fill 100 posts of doctors on contract basis through Walk in Interview by Director, Health Services.
The Cabinet also gave its approval to renew the contract of 64 dental doctors  appointed in the year 2007 on contract basis for next six months.
The Cabinet also gave its approval to fill up 11 posts of Assistant Professors in IGMC Shimla and one post of Associate Professor and six posts of Assistant Professors in Dr. Rajendra Prasad Medical College, Tanda by way of direct recruitment through H.P. Public Service Commission.
The Cabinet also approved to continue the existing  nine Fast-Track Courts  as such State Scheme.
The Cabinet also  gave approval for cancellation of  allotment of small hydro electric Projects viz.  one MW Parvati Hydro Power Project  in Kullu district  signed with M/s Modline Construction Private Ltd, Chandigarh, 1.5 MW Bhent Sanghni in district Chamba singed with M/s Modline Construction Private Ltd, Chandigarh, 1.80 MW Panchpul in district Chamba signed with M/s Janak Machines Private Ltd, Batala, Punjab, 2.80 MW Chhatri-I and 3 MW Chaini  power projects both in Chamba district signed with Ms. Pitambar Hydel Power Project district Kangra for not complying with requirements of the MoUs.  
The Cabinet decided to issue Letter of Indent in favour of M/s Kot Ghai Winery  Private  Ltd. Jhandewala Extension, New Delhi for setting up of Fruit based wine and cider manufacturing industry in Jaisghati of Theog teshil in Shimla district. All conditions necessary to set up such industries would also be applicable for this industry.
The Cabinet also approved rationalization of tax structure of Himachal Pradesh Passengers and Goods Taxation. According to rationalization Car/vehicles upto 1000 CC would be charged Rs. 1350 per annum, above 1000 CC upto 1500 CC Rs. 2400 per annum and above 1500 CC Rs. 2800 per annum.
The Cabinet also approved the upgradation and change of nomenclature of Health Educator in Dr. Rajendra Prasad Medical College, Tanda to Health Educator cum Lecturer.
The Cabinet also gave its approval to start BBA, MBA, B.Tech, BBA and LLB courses by ICFAI University  in Atal Shiksha Kunj, Kalu Jhanda, Baddi in Solan district as per Evaluation Report as well as Compliance Report submitted by the Inspection Committee and Institute of Chartered Financial Analysts of India Hyderabad respectively subject  to the conditions that in subsequent years University has to seek approval of the Government to start other courses keeping in view available infrastructure and faculty as per the norms.
 
26 Feb, 2011 Himachal Pradesh Cabinet in its Meeting held here today granted approval to the Right of Children to Free and Compulsory Education, Act, 2011, making it mandatory for every child in the age group of 6 to 14 years of age to get them free education and for providing congenial academic  atmosphere while banning rustication and torture etc..  Every child will be eligible to take benefit of education near to his home  while all  mandatory infrastructural deficiencies will be removed in next three years. Adequate number of teachers will be made available to students.  All such norms will be applicable to the private educational institutions as well where mandatory 25 percent seats would be mandatory to be made available to wards of weaker and backward sections of the society as per the State policy provisions.  All under-qualified teachers would be required to meet the minimum eligibility conditions in next five years while Central and State Level Advisory Committees would be constituted to monitor the implementation of the Act.
It granted approval to HP State Litigation Policy outlining broad guidelines on litigation strategies to be followed by the State Government or its agencies with a view to reduce litigation, saving avoidable costs on unproductive litigation, reducing litigation load on judiciary with respect to government induced litigation which is further aimed at ensuring dispensing of timely justice to the aggrieved parties.
It consented to amend the Recruitment Policy for the police constables to rationalize the procedure and make it  more transparent, practical and provide opportunity to maximum number of youth to take part in the recruitment process, especially youth from Gorkha Community which would  henceforth be eligible to compete for such posts with relaxed mandatory physical standard norms on the analogy of the recruitment to Armed Forces.
It approved Amendment in the Policy to open GNM and BSc. Nursing training institutes in the State.
It approved Amendment in Himachal Pradesh Administrative Service Rules, 1973. 
It approved absorption of 10 surplus employees of Public Works Department and HPMC in Treasury, Accounts and Lottery Department on secondment basis.
It granted approval to fill up one vacancy of District Controller, Food, Civil Supplies and Consumer Affairs through direct recruitment.
It approved establishment of a new Toll Barrier at Ratyor in Tax Revenue District, Baddi.
 
15 Feb, 2011 Himachal Pradesh Cabinet in its meeting held at Dharamshala  granted approval to recruit 165  Panchayat Sahayaks in the Department of Panchayati Raj on contract basis by following the roster system for smooth functioning of the gram panchayat offices and to  provide educated unemployed youth employment opportunities.
 It granted approval to creation of 12 posts of different categories to manage the ‘State Climate Change Centre’ at Shimla, under HP State Science, Technology and Environment Council.
It approved Amendment in Articles of Association of the Himachal Pradesh Power Corporation Limited and fixed the maximum number of Directors at nine and  further authorized the Corporation to avail loan/borrow money from Asian Development Bank in excess of the paid up capital and free reserves of the Company, to the extent of Rs. 3,500 crore  for execution of various Hydro Electric Projects allotted to the Corporation.
In order to implement the provisions of Energy Conservation Act, 2001 and to utilize State Energy Conservation Fund for the purposes of efficient use of energy and its conservation within State, the Government of Himachal Pradesh decided to frame the Himachal Pradesh State Energy Conservation Fund Rules, 2011.
It approved the Draft Governor’s Address to be delivered by H.E. the Governor, Himachal Pradesh, on the inaugural day of the Eleventh Session of the Himachal Pradesh Eleventh Vidhan Sabha.
It approved construction of Additional Block at Circuit House, Dharamshala, limiting its estimated cost to Rs. 2.46 crore.  The proposed block would also accommodate Ministers during the Winter Session of Assembly and save on extra expenditure being incurred on boarding and lodging in private hotels.
It authorized the Department of Excise and Taxation to carry auction proceedings for collection of tolls at Toll Barriers under the H.P. Tolls Act, 1975 for the year 2011-12 beginning from  April 1, 2011 to March 31, 2012.
It granted approval to leasing out of land at Bilaspur and Mashobra in district Shimla for setting up of Rural Self Employment Training Institutes (RSETI)  by UCO Bank, on a token lease payment of Re.1/- per month for 33 years.
It granted approval to absorb five drivers working under secondment from different Department/Board/Corporation in the HP Secretariat and making Amendment in the Recruitment and Promotion Rules for future recruitments in consultation with Finance and Personnel Departments.
It granted approval for filling up of one post of Assistant Professor in Oral and Maxillofacial Surgery Department of Government Dental College, Shimla.
In pursuance of the 74th Constitutional Amendment and Jawahar Lal Nehru National Urban Renewal Mission requirement of carrying mandatory reforms and resolutions adopted by the Municipal Corporation, Shimla, it has been decided to restore possession rights of the Shimla Town forest area with the Municipal Corporation for its preservation, conservation and maintenance.
It decided to issue No Objection Certificate in favour of Jagriti Sabha, Deodhar, in district Mandi to admit 20 candidates for GNM course as per the eligibility conditions of the Nursing Council of India.
It approved quashing of old and framing of new Recruitment and Promotion Rules for the post of Senior Ski Instructor in Atal Behari Vajpayee Institute of Mountaineering and Allied Sports, Manali.
It approved The Amendment in Himachal Pradesh Fiscal Responsibility and Budget Management (Amendment) Bill, 2011.
It approved Himachal Pradesh Panchayati Raj (Extension to the Scheduled Areas) Rules, 2011.
 
29 Jan, 2011 Himachal Pradesh Cabinet in its Meeting held here today approved constitution of a Cabinet Sub-Committee under the Chairmanship of Revenue Minister and comprising of Education, Irrigation and Public Health, Industries, Rural Development and Panchayati Raj, Transport Ministers, Chief Secretary as its Members and Principal Secretary (Personnel) as Member Secretary, to submit its recommendations regarding Implementation of the Constitution (85th Amendment) Act, 2001 and assignment of seniority to Scheduled Castes and Scheduled Tribes Government servants on promotion by virtue of rule of reservation/roster.      
It granted approval for filling upn of 225 posts of Shastri, 450 posts of Language Teacher, 200 posts of Art Teacher and 125 posts of Physical Education Teacher in the Department of Elementary Education in accordance with old as well as new Recruitment and Promotion Rules.  However, the selected teachers had to acquire requisite educational qualification in accordance with the Right of Children to Free and Compulsory Education Act, 2009 within the specified period of time to become eligible for future benefits.
It approved cancellation of allotment of Raula (1.25 MW); Pher (1.75 MW); Nalian (0.80 MW); Bourar (0.40 MW); Mallan (1.00 MW) and Uhl-II (1.00 MW).In an endeavour to make Himachal Pradesh a ‘Polythene Free’ State of the country, it decided to impose ban on  storage and use of non-biodegradable disposable plastic products i.e. plastic cup, plate and glass etc.. in the State from August, 15, 2011 and any offence committed shall be liable to get fined Rs. 5,000 for littering of non-biodegradable waste by any institution/commercial establishment and Rs. 1,000 for littering of non-biodegradable waste by individuals in the premises of any private or commercial establishments.
It approved naming of Reckong Peo Chowk against the name of late Shri Thakur Sen Negi as ‘Thakur Sen Negi Chowk’.
It granted sanction to filling up of one post Joint Labour Commissioner; two posts of Excise and Taxation Officers in the Department of Excise and Taxation; 12 posts of Civil Judge Junior Division for Subordinate Courts in the State; 8 posts of Clerks and two posts of Stenographers in HP Public Service Commission. Cabinet also granted permission to fill up  4 posts of Deputy Director, 11 posts of Welfare Organiser, 5 posts of Clerks and 2 posts of Steno Typists in the Sainik Welfare Department.
It accepted the proposal to enhance VAT on Tobacco and Tobacco Products from 13.75 percent to 16 percent and bring ‘beedies’ under goods taxable at special rate under new Schedule ‘E’ of HP VAT Act, 2005.
It consented to authorize HP Board of School Education to hire taxi on government approved rates to inspect private educational institutions for affiliation.
It agreed to shift National Highway Sub-Division of HP Public Works Department from Bilaspur to Shillai in district Sirmour to oversee the construction work of the new National Highway passing through the area.
It approved framing of Recruitment and Promotion Rules for the post of Senior Lecturer, Information Technology (Class-I Gazetted) and Amendment in the Recruitment and Promotion Rules for the post of Senior Lecturer, Applied Science and Humanities (Class-I Gazetted) in the Department of Technical Education.
It granted approval to the Amendment in the Himachal Pradesh Lokayukta Act, 1983.
 
6 Jan, 2011 Himachal Pradesh Cabinet in its Meeting held here today granted permission to create and  fill up 536 posts of different categories in different departments, Boards and Corporations of the State Government which include 300 vacancies of Constables in Himachal Pradesh Police through direct recruitment; 155 posts of Clerks in Education and 65 posts of Scientific, Technical and Non-Technical personnel in HP State Science, Technology and Environment Council  etc. to deliver people of the State efficient and quality services.
Cabinet took cognizance of the complaints received from different quarters and decided to convene Special Gram Sabha Meetings throughout the State in the month of April, 2011, to consider the complaints and carry out the additions and deletions in lists of BPL families in accordance with laid down norms.
It decided to authorize the Lok Mitra Kendras to issue copies of Domicile, Scheduled Caste/Scheduled Tribe Certificates to the general public by further authorizing the Revenue Department through Director of Land Records to enter into an agreement with two Service Centre Agencies (SCAs) approved by the State Government to  make  Lok Mitra Kendras functionally operational throughout the State.
It approved 3 percent reservation to the outstanding sports persons for winning Gold, Silver or Bronze Medals in All India and National Level School Games and National Women Sports Festival organised under Panchayat Yuva Krida Avam Khel Abhiyan (PYKKA) competitions.
It approved filling up of 155 posts of Clerks in the Department of Education from the Surplus Pool of the Boards and Corporations on secondment basis.
It sanctioned 65 posts of scientific, technical and non-technical categories for more effective functioning of the HP State Science, Technology and Environment Council.
It granted permission to fill up 4 posts of Deputy Superintendants of Police in the State Police through direct recruitment by HP Public Service Commission; 3 posts of Assistant Professors in Government Dental College, Shimla; one post of Scientific Officer in Zonal Forensic Laboratory at Mandi.
Cabinet approved strengthening of the Drug Controller Administration in the Department of Health and Family Welfare by sanctioning one post of Drug Controller; 4 posts of Drug Inspectors and also granted approval to ensure standardized manufacturing of quality medicines in the State.
It approved creation of one post of Land Acquisition Officer in Directorate of Energy; one post of Deputy District Attorney, to be filled up on secondment basis;  and two posts of Data Entry Operators to be filled up by outsourcing from DOEACC; in Medical Education Department; permanently absorb one surplus Personnel Assistant of Agro Industrial Packaging India Limited against the post of Research Assistant in the Department of Language and Culture
It approved Development Plan for Left Out Area of Kullu Valley Planning Area to create quality public amenities of Parking lot and Warehousing Complex at Palchan; Fruits and Vegetable Regulated Markets, including Truck Terminals at Patlikuhal and Bandrol (Alu Ground), to facilitate locals and visitors as also to maintain the natural grandeur of the world famous Kullu-Manali Valley.
It approved implementation of Integrated Child Protection Scheme in the State on the Guidelines issued by the Government of India, and authorized the Department of Social Justice and Empowerment to sign MOU with the Government of India on behalf of the Government of Himachal Pradesh.
It granted approval to the Amendments in Himachal Pradesh Lease Rules, 1993 to provide concessions to the Himachal Pradesh Independent Power Producers allotted HEPs upto 2 MW capacity for execution, by reducing existing lease rate from 18 percent to 15 percent. 
It approved open auction/tender procedure to be adopted to dispose off land owned by HPMC at Chennai by fixing reserve price at  Rs. 15,60,93,978.It also approved transfer of land owned by Agro Industrial Packaging India Limited at Pragati Nagar in Kotkhai in the name of Technical Education Department, free of cost, for opening of an Engineering College.

Cabinet approved Amendment in the Himachal Pradesh Panchayati Raj (Finance, Budget, Accounts, Audit, Works, Taxation and Allowances) Rules, 2002 to authorize Takniki Sahayak to execute original developmental works-upto Rs. 1.5 lakh; Junior Engineer-upto Rs. 5 lakh; Assistant Engineer-upto Rs. 10 lakh and Executive Engineer above Rs. 10 lakh in the Gram Panchayats under different developmental programmes approved by the State Government from time to time.
It approved general Recruitment and Promotion Rules for the posts of Junior Scale/Senior Scale Stenographers for direct recruitment for all Government Departments in the State.
